A New York judge handed a victory to vapers Feb. 5, declaring vape vs. smoke is not the same as smoking and e-cigarette use is not necessarily banned in all the same places as smoking.
“An electronic cigarette neither burns nor contains tobacco,” said the court.
“Instead, the use of such a device, which is commonly referred to as ‘vaping,’ involves the inhalation of vaporized e-cigarette liquid consisting of water, nicotine, a base of propylene glycol or vegetable glycerin and occasionally, flavoring.”

As cities ban the practice of vaping which is absolute insanity. I would venture a guess that these same cities are deodorizing their office buildings with chemicals that are more harmful and contain allot of the same chemicals as a cigarette. Read more on the dangers of air fresheners.
Americans for Non Smoker Rights reports over 53,000 people die every year from second hand smoke. People do have a concern when they see a giant vape plum around an individual who's vaping. That concern stems from the dangers and proven deaths from smoke. Keep in mind vape is not smoke it's steam, or vape.

Our friends in media in Sioux Falls have gone to their corporate attorney’s on the legalities of Vape advertising. The responses we are receiving from local media are that it is permissible to advertise, there are some regulations:
It’s an 18 and over product
Products cannot be advertised as healthy (although vaping can differentiate itself from smoking)
Advertising should not target children
Products can be advertised as an alternative to smoking
Products can be advertised as not containing the same harmful ingredients as Big Tobacco
Quite frankly the cost savings alone versus big tobacco are a strong enough advertising statement, saving former smokers thousands a year! The ability to vape inside and have your house or car not reek like an ashtray is an amazing bonus. Plus the fact that vaping is steam not fire and smoke, speaks volumes as to why vaping is a better option for people who enjoy nicotine (without yellow teeth).
In 1965 America drew a line in advertising cigarette products, especially to youth. In fact most big tobacco advertising today is banned on TV and Radio. You will find most marketing of smoking in Hollywood Films or Magazines with adult subscribers. The Days of billboards featuring Camel Joe and even Nascars Winston Cup are a memory for most of us! The younger generations have never been exposed to this type of marketing.
As communities throw down vaping bans, regulate vape advertising and implement codes with no merit or health knowledge available to substantiate such laws, it simply is mind boggling. Meanwhile the Mother Land England whom is far more advanced then the United States with Government Healthcare (Amazing- you don’t have to go bankrupt, do fundraisers, and sell assets if you're diagnosed as severely ill in England)! England is providing vaping units and juice free in their National Healthcare. England wants to get their citizens off the smokes, the country is deeming vaping 95% safer versus smoking.
Now Facebook is stepping in banning vape advertising products grouping the products with tobacco. Now there’s a petition calling Mark Zuckerberg to change the definition. First of all there is no tobacco in vape products. In fact the nicotine found in vaping comes from a vegetable. This is why the states cannot tax it as a tobacco product. There is no tobacco, 100% tobacco free. In a court of law it’s pretty clear you can’t even tax the product as tobacco, there is none! Vaping has taken millions of users away from smoking, and voters are fed up with the rhetoric and senseless laws being introduced regarding vaping and e-cigs. Cigarette sales are plummeting and the tax dollars collected are hitting states in the wallet. This motivator alone impels politicians to cry for more taxes on vaping (which clearly isn’t smoking) it also fuels the fire to label vaping as unsafe, untested with unsubstantiated rumors that vaping is more harmful than smoking!
